Novo Pedido de Discriminação Positiva
Pela Resolução do Conselho de Ministros nº 75/2010, de 9 de Setembro, publicada no Diário da República, I série, nº 185, do dia 22 do mês de Setembro, o Governo decidiu introduzir um regime efectivo de cobrança de taxas de portagem nas auto-estradas das SCUT Norte Litoral, Grande Porto e Costa de Prata, a partir do próximo dia 15 deste mês de Outubro adoptando-se, no entanto, um regime de discriminação positiva, na cobrança das taxas de portagem, para os utilizadores locais.
Nos termos do nº 6 da citada RCM consideram-se utilizadores locais das SCUT Norte Litoral, Grande Porto e Costa de Prata, aqueles que residam ou tenham sede nos concelhos em que uma qualquer parte do seu território fique a menos de 10km das respectivas vias.
Na sequência da referida RCM a Portaria Conjunta dos Ministros das Finanças e da Administração Pública e das Obras Públicas Transportes e Comunicações, Portaria nº 1033-A/2010 de 06 de Outubro, veio estabelecer o anunciado regime de discriminação positiva, através do qual se confere às populações e empresas locais o seguinte benefício:
(i) isenções do pagamento de taxas de portagem nas primeiras 10 utilizações mensais da respectiva SCUT; e
(ii) descontos de 15% nas utilizações seguintes na mesma SCUT e no mesmo mês.
Para beneficiar do regime de Discriminação Positiva, ainda nos termos da atrás referida Portaria, deverá ser titular de um Dispositivo Electrónico de Matrícula (DEM), o que implica a conversão do Identificador Via Verde em Dispositivo Electrónico de Matrícula (DEM), o que, e de acordo com a Portaria nº 314 – A/2010, de 14 de Junho, determina a transmissão dos seus dados pessoais (matrícula e código de equipamento) ao Instituto Mobilidade e de Transportes Terrestres (IMTT) para registo dos mesmos em base de dados.
A atribuição definitiva do benefício da Discriminação Positiva depende da apresentação no prazo máximo de 60 dias dos seguintes documentos:
- Documento único da viatura, ou,
- Título de registo de propriedade ou em alternativa Certificado de matrícula original ou cópia autenticada,
- Declaração passada pelo locador que identifica o nome e a morada da residência ou sede do locatário nas situações de viaturas em regime de locação financeira ou similar.
A apresentação dos documentos acima referidos poderá ser efectuada:
- Por correio através do envio de cópias autenticadas, acompanhadas do comprovativo, devidamente assinado pelo requerente, disponível para impressão no final da submissão do presente pedido, para a seguinte morada:

Após submissão do pedido poderá circular nas infra-estruturas rodoviárias das referidas SCUT’s de que seja, nos termos atrás referidos, utilizador local, beneficiando das condições previstas na referida Portaria nº 1033-A/2010.
O pedido produz efeitos 48 Horas após o seu registo e tem carácter provisório. Em caso de expiração do prazo de 60 dias sem que proceda à apresentação dos documentos acima identificados ou em caso de rejeição pelo IMTT do pedido de registo da conversão do Identificador em DEM o pedido será cancelado. O cancelamento do pedido responsabiliza o Cliente por eventuais prejuízos causados às Concessionárias e Subconcessionárias.
A qualquer momento, poderá cancelar o registo do Dispositivo Electrónico de Matrícula, perdendo assim o direito ao Regime de Discriminação Positiva mantendo-se em vigor o seu contrato com a Via Verde.
Para dar seguimento ao pedido de habilitação ao regime de discriminação positiva deverá proceder ao preenchimento dos campos que a seguir se disponibilizam para o efeito.

Declaração passada pelo locador que identifica o nome e a morada da residência? O que querem dizer com isso? Fotocópia da carta de condução serve?
